1. Acceptance of Terms
By registering, accessing, or using the KonversiMAX platform operated by PT Akses Digital Indonesia (“Company,” “we,” “us”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”).
If you are using the service on behalf of an organization or company, you represent and warrant that you have the authority to bind that organization to these Terms.
We reserve the right to update these Terms at any time. Material changes will be communicated at least 14 days before taking effect.
2. Description of Service
KonversiMAX is a multi-tenant Software-as-a-Service (SaaS) platform that provides:
- Conversion tracking and attribution for digital advertising campaigns (Facebook, Google, TikTok)
- Multi-inbox WhatsApp Business management with integrated CRM chat
- Two-way advertising platform integrations (Conversion API, Offline Conversion Upload)
- Analytics dashboards and campaign performance reporting
- Additional features that may be added over time
Services are available on a monthly subscription basis according to the plan you select.
3. Registration & Account
3.1 Eligibility
You must be at least 18 years of age and have the legal capacity to enter into binding agreements. Use of the service for illegal business purposes is not permitted.
3.2 Accuracy of Information
You agree to provide accurate, complete, and current information during registration and throughout your use of the service. You are responsible for all activity that occurs under your account.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and must notify us immediately of any unauthorized access. We are not liable for losses resulting from unauthorized use of your account due to your negligence.
3.4 Staff Accounts
You may invite staff members to access your workspace. You are responsible for ensuring all staff comply with these Terms and for their actions within the platform.
4. Subscription & Payment
4.1 Plans and Pricing
KonversiMAX offers multiple subscription tiers (Free, Solo, Starter, Pro, Agency) with varying features and limits. Prices are listed in Indonesian Rupiah (IDR) and may change with 30 days' notice.
4.2 Billing Cycle
Paid subscriptions are billed monthly at the start of each billing period. All payments are non-refundable except as required by applicable law.
4.3 Free Trial
A 14-day free trial is available to new users with full access to paid features. Upon expiry, the account reverts to the Free plan unless you choose to upgrade. No credit card is required for the trial.
4.4 Upgrades & Downgrades
You may change your subscription plan at any time. Upgrades take effect immediately; downgrades take effect at the start of the next billing period. No partial refunds are issued for downgrades.
4.5 Late Payment
Accounts with unpaid invoices for more than 7 days will have their access restricted. Accounts unpaid for 30 days may be deactivated. You are responsible for any taxes applicable to your subscription under local law.
5. Permitted Use
You are permitted to use KonversiMAX to:
- Track conversions from your legitimate digital advertising campaigns
- Manage WhatsApp Business conversations with your customers
- Integrate conversion data with advertising platforms you are authorized to use
- Analyze and optimize your marketing campaign performance
- Invite and manage staff members to help operate your workspace
6. Prohibited Use
You agree not to use the service to:
- Conduct any activity that violates Indonesian law or applicable international law
- Send spam, unsolicited bulk messages, or violate WhatsApp Business Platform policies
- Reverse engineer, decompile, disassemble, or copy the platform
- Resell, sublicense, or transfer access to the platform without prior written consent
- Interfere with or damage the platform's infrastructure or security
- Store or process data that infringes third-party rights or violates data protection laws
- Circumvent or attempt to exceed plan-based usage limits
- Use automated systems (bots, scrapers) to access the platform in ways not permitted by our API terms
Violation of these prohibitions may result in immediate account termination without refund.
7. Intellectual Property
The KonversiMAX platform, including all software, designs, text, graphics, and content, is the exclusive property of PT Akses Digital Indonesia and is protected by Indonesian and international intellectual property laws.
Your use of the service does not grant you any ownership rights over the platform or its components. You receive only a limited, non-exclusive, non-transferable license to use the service in accordance with these Terms.
Your business data and customer data that you input into the platform remain your property. You grant us a limited license to process and store this data solely for the purpose of providing the service.
8. Data & Privacy
The collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also accept our Privacy Policy.
You represent and warrant that you have the necessary rights, consents, and legal bases to provide us with your customers' data for processing through the platform, in compliance with all applicable data protection laws.
9. Disclaimer & Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that: (a) the service will be uninterrupted or error-free; (b) results obtained through the service will meet your expectations; or (c) all defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
10. Termination
10.1 By You
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Your data remains available for export for 30 days after cancellation.
10.2 By Us
We reserve the right to suspend or terminate your account immediately and without prior notice if you violate these Terms, engage in illegal activity, or pose a threat to platform security or other users.
10.3 Effect of Termination
Upon termination, your right to access the service ceases immediately. We will delete your data in accordance with our retention policy described in the Privacy Policy.
11. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law principles.
Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If no resolution is reached within 30 days, disputes shall be submitted to the South Jakarta District Court (Pengadilan Negeri Jakarta Selatan), Indonesia.
12. Miscellaneous
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the service.
- No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
